The department’s mandate is derived from the following: The National Education Policy Act of 1996 enshrines in law the Minister of Basic Education’s policies, legislative and monitoring obligations, and the formal relationships between national and provincial authorities. The South African Schools Act of 1996 encourages access to education, quality, and democratic governance in the educational system, and makes schooling compulsory for children aged seven to fifteen, ensuring that all learners have equal access to a high-quality education. The Employment of Educators Act of 1998 governs educators’ professional, moral, and ethical obligations, as well as teacher competency standards.
